1. Introduction
By accessing or using the Combustible Dust Dashboard ("dashboard") from the Combustible Dust Performance-Based Design Center ("Dust Center"), you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, you may not access or use the dashboard.
2. Use of the Dashboard
The dashboard is provided for informational purposes only. You agree not to download the data for independent usage, nor use it as the basis for the evaluation of hazardous process or operating conditions. You agree not to use the dashboard API outside of the dashboard webpage, and agree to pay any fees which originate from this unauthorized usage.
3. Liability
We are not responsible for any damage or loss that may arise from your use of the dashboard or materials posted on the Dust Center website. We make no warranty or representation about the accuracy, completeness, or reliability of the data in the dashboard, and we are not responsible for any incorrect data that may be in the dashboard.
4. Intellectual Property
The dashboard code is the property of the Dust Center and is protected by intellectual property laws. You agree not to use any part of the dashboard code for commercial purposes or in any way that infringes our intellectual property rights.
5. Indemnification
You agree to indemnify and hold Marquette University and the Dust Center harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the dashboard.
6. Termination
We reserve the right to terminate your access to the dashboard at any time without notice for any reason.
7. Changes to Terms and Conditions
We reserve the right to modify these terms and conditions at any time without notice. Your continued use of the dashboard after any changes to these terms and conditions constitutes your acceptance of the new terms and conditions.
8. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of the United States of America and the state of Wisconsin.
9. Entire Agreement
These terms and conditions constitute the entire agreement between you and the Dust Center with respect to the dashboard, and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and the Dust Center regarding the dashboard.
